Welcome to Founder Launch Studio (“FLS”, “we”, “us”, “our”), an online venture-building school operated by Focas Property (ABN 83 631 458 761) (“Focas Property”), based in Queensland, Australia. These Terms of Service (“Terms”) govern your access to and use of the Founder Launch Studio website, platform and services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
2. What the Service is
FLS is an educational program that guides founders through structured stages of venture-building. You read lessons, submit written assignments, and receive feedback and a score generated by an artificial-intelligence system we call your “Founder Coach”. The Service is designed to develop your thinking and decision-making as a founder.
3. Educational purpose only — not professional advice
The Service, including all lessons, rubrics, scores, feedback and coaching, is provided for general educational and informational purposes only. It is not, and must not be relied upon as, professional advice of any kind — including legal, financial, investment, accounting, tax or business advice. You should obtain your own independent professional advice before making any business or financial decision.
4. AI-generated feedback
Feedback and scores are generated by an automated AI system. AI systems can produce information that is inaccurate, incomplete or not suitable for your circumstances. You are responsible for evaluating the feedback and deciding whether and how to act on it. A score (including a “pass”) reflects the AI’s assessment of your submission against a rubric — it is not a guarantee, endorsement, certification or prediction of any real-world result.
5. No guarantee of outcomes
We do not guarantee any particular result from using the Service, including any level of business success, revenue, funding, customers or launch. Your results depend on many factors outside our control.
6. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service.
7. Your account
You are responsible for providing accurate information, keeping your login details secure, and all activity under your account. Please notify us promptly of any unauthorised use.
8. Subscriptions, fees and payments
Stage 1 is free. Access to the remaining stages is offered on a paid monthly subscription. Fees and inclusions are shown before you subscribe. Founding members who join at the founding rate keep that rate for the life of their continuous subscription; the standard rate applies otherwise. Subscriptions renew automatically each month until cancelled. You may cancel at any time, and cancellation takes effect at the end of the current paid period. We offer a full refund if you request it within 7 days of a charge (see our
Refund Policy); outside that window, payments for partial periods are otherwise non-refundable. Payments are processed by Lemon Squeezy, which acts as the merchant of record (the seller of record) and collects any applicable taxes. Nothing in these Terms limits rights you have under the Australian Consumer Law (see clause 13).
9. Your content and intellectual property
You retain ownership of the venture ideas, submissions and other material you provide (“Your Content”). You grant us a non-exclusive, worldwide licence to store, process and use Your Content for the purpose of operating the Service and providing your feedback — including processing it through our third-party AI and infrastructure providers (see our Privacy Policy). We do not claim ownership of your venture or business ideas.
All other content and materials in the Service — including the lessons, curriculum, rubrics, prompts, the “LaunchOS” engine, software, branding and design — are owned by Focas Property or its licensors and are protected by intellectual-property laws. You may use them only as part of your permitted use of the Service and must not copy, resell or redistribute them.
10. Acceptable use
You agree not to misuse the Service, including by: breaking the law; infringing others’ rights; uploading harmful, unlawful or infringing content; attempting to access other users’ data; reverse-engineering or scraping the Service; or interfering with its operation or security.
11. Third-party services
The Service relies on third-party providers (for example hosting, database, email, payment and AI providers) to function. Your use of the Service involves your data being processed by these providers as described in our
Privacy Policy.
12. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive termination (including clauses 3–5, 9, 13 and 14) will survive.
13. Australian Consumer Law
Our Service comes with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability can be limited, it is limited to (at our option) re-supplying the relevant service or paying the cost of having it re-supplied.
14. Limitation of liability
To the maximum extent permitted by law and subject to clause 13, we are not liable for any indirect, incidental or consequential loss, or for any loss of profit, revenue, data or business opportunity, arising from your use of the Service or your reliance on any feedback, score or content. Nothing in these Terms limits liability that cannot be limited by law.
15. Changes
We may update the Service and these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by posting an updated version with a new effective date). Continued use after changes take effect means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland.
